Marlon Passley was convicted of a 1995 shooting that occurred in Mattapan, MA. Passley was convicted solely on eyewitness testimony. The district attorney’s office reopened Passley’s case, and reexamined the testimony against him, after learning of evidence that seemed to point to Passley’s innocence. David Meier, a Suffolk county prosecutor, asked the judge to vacate Passley’s conviction. Passley was released from prison in 1999 and was formally exonerated in 2000. Passley’s case is a textbook example of mistaken identity.
